Terms & Commission Information

These Terms & Conditions apply to bespoke pet portrait commissions purchased from NSANTAMARIART.
NSANTAMARIART is the trading name of Karen Nicole Santamaria Granizo, a sole trader based in London, UK.
1. Enquiries and booking
All commissions begin with an enquiry through the website. After reviewing your requirements, I will confirm whether I can accept the commission and the estimated timeframe available.
A commission is only considered booked once the required reservation payment has been received, which secures dedicated time in my commission schedule and is deducted from the final balance.
2. Reservation payment
For standard collections:
Petite Collection
- Total: £295
- Reservation: £150
- Final balance: £145
Signature Collection
- Total: £450
- Reservation: £225
- Final balance: £225
For custom commissions, the total price and reservation amount will be agreed individually based on factors such as size, number of pets and the requirements of the commission.
Reservation payments are non-refundable as they secure specific time in my schedule, subject to applicable consumer law.
3. Process & Approval
I create each portrait using the reference photographs and information provided during the enquiry and commission process.
For commissions requiring a specific composition or personalised elements, I may provide a sketch, composition or other visual proposal for your approval before proceeding with the main artwork.
Once any required composition or personalised elements have been approved, they will form the basis for the final artwork.
If you request changes after approval, I will assess whether the requested change is technically feasible. If the change is feasible, an additional charge may apply depending on the amount of additional work required. I will confirm any additional charge before carrying out the change. If a requested change is not technically feasible, I may decline the request.
4. Final payment
Once your portrait is completed, I will send you a Stripe payment link for the remaining balance. The artwork will be shipped once this final payment has been received.
No additional payment will be requested beyond the agreed commission price unless you have approved an additional charge, such as a requested change or agreed customisation.
Shipping & Delivery
Shipping
Worldwide tracked shipping is included in the standard commission price. Your finished portrait will be carefully packaged to protect it during transit. I will provide tracking information once dispatched.
Delivery times & Address
Delivery times vary by destination and the shipping service available. Please note that estimates may be affected by circumstances outside my control, such as customs processing or courier delays.
The customer is responsible for providing an accurate delivery address. If an artwork cannot be delivered due to incorrect details, additional shipping costs may apply.
Customs & Import Charges
For international orders, any customs duties or import taxes imposed by the destination country are the responsibility of the customer.
Damaged artwork
If your artwork arrives damaged, please contact me immediately at nsantamariart@gmail.com with photographs of the artwork and packaging. I will work with you to determine the appropriate resolution.
5. Cancellation and refunds
Because commissions are bespoke artworks created specifically for each client, cancellation and refund rights may differ from those applicable to standard, non-personalised goods.
Reservation payments are non-refundable when a client cancels a booked commission, subject to any rights that cannot legally be excluded.
If I am unable to complete a commission for reasons attributable to me, I will provide a full refund of amounts paid.
Nothing in these Terms & Conditions affects any statutory rights you may have under applicable consumer law.
6. Artwork and copyright
The original artwork becomes yours once the agreed commission has been fully paid.
Copyright and intellectual property rights remain with the artist unless otherwise agreed in writing.
You may display and enjoy the artwork for personal use, but you may not reproduce, sell, commercially exploit or alter the artwork without my written permission.
With your permission, I may photograph completed artwork and share it on my website, portfolio or social media for promotional purposes.
